أولاً : المتطلبات الإدارية المتعلقة بالوكيل .

1. رخصة المستودع/الشركة صادرة عن وحدة الإجازة والتراخيص في وزارة الصحة الفلسطينية.
2. وكالة و تفويض للشركة / المستودع  بتسجيل مستحضرات الشركة المنتجة مصدقة حسب الأصول ( وزارة الخارجية و السفارة الفلسطينية ) .
3. طلب التسجيل معبأ حسب الأصول.

ثانياً : المتطلبات الإدارية المتعلقة بالمصنع(الشركة المنتجة).

1. رخصة المصنع صادرة عن السلطات المختصة في بلد المنشأ مصدقة حسب الأصول .
2. شهادة البيع الحر لكل مستحضر صادرة عن السلطات المختصة في بلد المنشأ، مصدقة حسب الأصول ، على أن تحتوي على عبارة صريحة تفيد بأن الصنف متداول في بلد المنشأ بنفس الاسم التجاري والتركيبة .
3. شهادة الممارسة الصناعية الجيدة (GMP) صادرة عن السلطات المختصة ومصدقة حسب الأصول .
4. متطلبات التسعير وفقاً للملحق الخاص بالتسعير.
5. قائمة بأسماء الدول التي يتم تداول المستحضر فيها.
6. تعهد خطي من المصنع بوجوب إبلاغ الجهات المعنية في وزارة الصحة الفلسطينية في حالة وقف إنتاج المستحضر أو سحب أية تشغيلة له من الأسواق مع ضرورة ذكر السبب لذلك.

• البنود من 1-4 مطلوب تصديقها من وزارة الخارجية والسفارة الفلسطينية .

ثالثاً : المتطلبات الفنية .

1. الوثائق التالية والتي يشترط أن تكون أصلية ( مختومة من الشركة المنتجة ):

أ‌-       التركيبة الرئيسية للمستحضر تحتوي على جميع المواد الداخلة في التصنيع ( الفعالة وغير الفعالة ) وكمياتها، والمرجع المستند عليه.

ب‌-  شهادات تحليل ومواصفات المواد الأولية الداخلة في التركيبة من بلد المنشأ، مع ضرورة إرفاق صور(ة) عن المرجع أو المراجع التي استند عليها في وضع المواصفات.

ت‌-     مواصفات المستحضر النهائي.

ث‌-        شهادة تحليل المستحضر النهائي.

ج‌-     شهادة صادرة من الشركة المنتجة توضح فترة حياة الرف للمنتج النهائي وظروف التخزين وفقاً لفحص الثبات.

ح‌-     مواصفات الغلاف الداخلي والخارجي للمستحضر النهائي مع وجوب إرفاق عينات فارغة منها، والالتزام بالبيانات الواجب توفرها على العبوات الداخلية والخارجية على أن يطبع على العبوة الخارجية واللاصق الداخلي عبارة مكمل غذائي بخط واضح ومميز .

1. شهادة صادرة من المصنع ( الشركة المنتجة) ومصدقة من وزارة الصحة في بلد المنشأ تفيد بأن المستحضر خالي من مشتقات الخنزير، وجنون البقر(BSE)، وبقايا المبيدات الحشرية والمعادن الثقيلة أو أية مواد طبيعية أو كيماوية قد تسبب ضرر للجسم أو تؤثر على السلوك الطبيعي للإنسان.

1. عينات كافية لثلاث تحاليل مخبريه كاملة.

ملاحظة : لدائرة التسجيل الدوائي الحق في طلب أي متطلبات أخرى تراها ضرورية.

Food Supplements Registration Requirements (Imported)

Every importing or manufacturing company is required to submit the following for the registration purposes of food supplement products:

First / Administrative Requirements related to the agent :

1. A License of food supplement store (or equivalent), manufacturing company issued by the licensing unit/Ministry of Health.

1. An authenticated letter from the manufacturer showing that the importing company is the sole agent of the producing company and authorized for registration in the Palestinian National Authority , duly certified ( Ministry of Foreign Affairs and Embassy of Palestine )

1. Registration application forms dully filled .

Second / Administrative Requirements of the plant ( the manufacturer )

1. The manufacturing company is licensed and approved to manufacture food supplement products. This letter should be approved as required .

1. A free sale certificate issued from the health authorities clarifying that the product is sold freely in the country of origin, as a food supplement and not as a therapeutic agent under the same name, composition and directions mentioned in the application form for registration. The product should be dealt with in the country of origin for more 2 years .

1. The manufacturing company is implementing the Good Manufacturing Practices requirements (GMP) and is under the continuous supervision and control of the specialized authority.

1. The following documents approved by the specialized authorities of the producer`s country:

• Price to the public in the country of origin.
• Export price to Palestine (F.O.B).
• Suggested price to consumer in Palestine.

1. A list of the countries where the product is sold .

1. Declaration from the manufacturing company stating that they are committed to inform the Palestinian Ministry of Health if they stop manufacturing the products or withdraw them from the market and the reasons behind that.

Items from : 1-4 ratification is required from the Ministry of Foreign Affairs and the Palestinian embassy

Third / The Technical Requirements :

1- The following documents which are required to be original ( sealed from the manufacturer ) :

• Master formula including all ingredients and their quantities expressed in (V/V, W/V, W/W or %).

• Specification of the raw materials included in the manufacturing product including a copy of the reference(s) used and certificates of analysis from the manufacturer.

• The finished product specifications.

• Certificate of analysis of the finished product .

• Certificate prepared by the manufacturer including the shelf life and required storage conditions .

• Labels and packaging materials specifications and samples with a commitment to the data should be available on the internal and external packaging and printing on the outer packaging and internal adhesive a statement of “dietary supplement”

           2-Samples from the finished product and the active ingredient(s) sufficient for at least three analyses

3-Health certificate issued by the manufacturer and approved by the specialized health authorities declares that the products are free from hormones, antibiotics, alcohol, pork products ,pesticide residues ,heavy metals, narcotic products, steroidal, anabolic, active pharmaceutical ingredients, or any chemical ingredients that may cause harm to the body or behavior and the products does not have any side effect like addiction or cell damage. This certificate should be authenticated as required .

        4-Any additional requirements requested by the department.

تهيب وزارة الصحة بالإخوة الصيادلة الكرام الالتزام بما ورد في نظام مزاولة مهنة الصيدلة في فلسطين الصادر بقرار من مجلس الوزراء رقم (02/37/10/م.و/إ.ه) لسنة 2006 والذي ينص على ما يلي:

المادة 22:

 يحظر على الصيدلية العامة جلب أو شراء الأدوية أو المستحضرات الطبية إلا من الجهات المرخصة لذلك وبالطرق القانونية.

المادة 30:

1.  لا يجوز لأي مستودع بيع أو شحن أو تسليم الأدوية والمستحضرات والمستلزمات الطبية إلى الصيدلي المسئول قبل أن يلصق على غلافها الخارجي رقعة التسعيرة المعتمدة من النقابة واسم المستودع المورد دون مسح أو تصحيح في الأرقام وعلى الصيدلي المسئول المتسلم أن يرفض قبولها بدون رقاع التسعيرة واسم المستودع المورد، وبخلاف ذلك يعتبر كل من مالك المستودع والصيدلي المسئول مخالف.
2. يجب ألا تخفي رقاع التسعيرة البيانات الأصلية الضرورية ( كيفية الاستعمال أو اسم العلاج أو تاريخ النفاذ أو عبارة عينة طبية وظروف تخزينه ورقم التشغيلة) وإلا اعتبر الدواء أو المستحضر مشبوهاً ويصادر حيثما وجد فضلاً عن الملاحقة القانونية.

المادة 34:

يحظر على المؤسسة الصيدلانية شراء الأدوية إلا من الجهة المرخص لها ببيعها كما يحظر عليه بيع الأدوية التي انتهت صلاحيتها أو العينات الطبية المجانية أو الأدوية التالفة أو المهربة أو المباعة لوزارة الصحة أو الخدمات الطبية العسكرية أو وكالة الغوث، أو تبرعات الأدوية الواردة إلى فلسطين.
